    Patent Protection for Software Inventions in Europe PATENTS

    Inventions related to user interfaces, business methods, mathematical methods and simulations require extra care in Europe. Inventions related to image processing and cryptography are usually considered to have technical character in Europe. Computer-implemented inventions can be found in all fields of technologies, ranging from computer and mobile to biotechnology applications. Article 52 of the European Patent Convention (EPC) states that a patent should be granted in any field, although the EPC also explicitly regards computer programs as not being inventions if claimed as such. Moreover, methods for performing mental acts, playing games, doing business and presenting information are also not considered to be inventions under the EPC.

    CNIPA: All 85 RCEP IP Obligations Fulfilled

    This January marks the first anniversary of the Regional Comprehensive Economic Partnership (RCEP) agreement after its effectiveness. As trade and investment have been continuously liberalized and expedited among RCEP member countries over the past year, IP, as an important force for promoting regional economic and trade cooperation, is playing an increasingly significant role. In the RCEP agreement, the chapter on intellectual property has the greatest content and length, and it is also an IP-related chapter that has incorporated most comprehensive contents among all the FTAs ever signed by China. No wonder it has sparked wide attention since the get-go. Our reporter learned from the China National Intellectual Property Administration (CNIPA) that in the past year, all the 85 obligations specified in RCEP's IPR chapter involving the highest IP authority in China have been fulfilled.

    WIPO Invites Applicants for 2023 Global Awards Competition for SMEs

    WIPO has opened the 2023 edition of its Global Awards program, seeking small and medium-sized enterprises (SMEs) candidates from around the world that use intellectual property (IP)-backed innovation and creativity in an exceptional manner to achieve business goals and improve society. WIPO’s Global Awards 2023 are open to SME applicants of the entire range of business activity - the creative industries, local and international brands, innovative technological providers and all others. An independent jury of renowned experts will select up to seven winners from a shortlist of 20 nominees based on a range of criteria, including the successful commercialization of IP and its positive contribution to society. Diversity of the contenders is also considered. Winners receive a tailored 1:1 mentoring package to support their IP strategies - including funding facilitation, partnership opportunities and publicity support. Winners will receive their awards at a ceremony at WIPO’s Geneva headquarters during WIPO’s General Assembly in July 2023.

    China Sees Patents, Trademarks Filed by Foreign Entities Rise

    China recorded a stable growth of patents and trademarks applied by foreign entities last year, showing intellectual property was playing a bigger role in promoting the country's high-quality opening-up, IP regulators said. In 2022, the number of valid invention patents applied by foreign entities in China rose by 4.5 percent compared with that in 2021, bringing the total to 861,000, said Hu Wenhui, deputy head of the China National Intellectual Property Administration, at a news conference on Monday. Last year's patents involved 58,000 foreign enterprises, 2,000 more than that in 2021, he said. The figure of valid trademarks registered by foreign entities increased by 5.9 percent year-on-year in 2022, bringing the total to 2.03 million, he added. "The growth fully demonstrates that our efforts in IP protection have provided a sound business environment for foreign-invested enterprises in China," said Zhang Zhicheng, head of the administration's IP Protection Department, emphasizing that "we've given equal IP protection to companies, no matter where they're from."

    Platinum-Boosting Clean Hydrogen Projects, Patents are All the Rage

    Clean hydrogen patent innovation is all the rage, say IEA and EPO. The implementation agreement for Namibia’s planned multibillion-dollar Hyphen Hydrogen Energy project is scheduled to commence in the first quarter of this year, Namibia President Hage Geingob revealed in his 2023 New Year’s message. Egypt has granted approval for two green hydrogen projects in the industrial zone of Ain Sokhna, a port town on the Red Sea. Africa can produce 50-million tons of green hydrogen a year by 2035 with the help of the platinum group metals (PGMs) that the continent hosts in world-leading quantity, a study by European Investment Bank, International Solar Alliance and the African Union highlights. South Korea intends creating six hydrogen cities that will use hydrogen in buildings and transport as part of daily life, Hydrogen Insight reports. Scotland has let it be known that it will call for green hydrogen proposals early this year as part of installing 5 GW of renewable generation capacity by 2030.

    China Profoundly Participates in IP International Cooperation

    "China has always attached great importance and been actively committed to intellectual property (IP) protection, which provided effective support for improving innovation and advancing high-quality development. While stepping up its work on IP, China has been deeply engaged in international IP cooperation," said Wang Wenbin, China's Foreign Ministry Spokesperson, at a regular press conference recently. China continues to optimize IP protection. The proportion of patentees experiencing patent infringement sheds to a historical low. Only 7.7% of Chinese patentees had experience in infringement in 2022 - the second straight year with a sub-8% reading, according to China Patent Investigation Report 2022. Corporate patentees have a more diverse toolkit to enforce their right after being infringed. In 2022, 72.7% of them chose to respond after being infringed, maintaining on the plus side of 70% for the fourth consecutive year. In recent years, an increasing number of Chinese applicants have been making foreign countries destinations for their patent applications.

    Supreme People's Court Mandates Better Handling of IP

    Chinese courts are required to make greater effort when dealing with intellectual property cases involving core technologies and emerging businesses this year, to promote new development patterns and high-quality growth. The better handling of IP disputes and other cases involving emerging industries will stimulate innovation and advance the digital economy, the Supreme People's Court said while raising the requirement at an annual court meeting on Sunday. China's top court called for judges to fully protect the rights of private businesses and entrepreneurs, with greater focus on solving bankruptcy and financial cases.
