Fees of PCT Application in the International Phase to Be Collected in RMB Standard From December 01

From December 01, 2021, in accordance with the Memorandum of Understanding for Remittance of (PCT) Fees signed between China National Intellectual Property Administration and World Intellectual Property Organization, China National Intellectual Property Administration will collect the fees of PCT application in the international phase subject to the RMB standard published by the World Intellectual Property Organization, which will no longer be calculated by the Swiss Franc standard.

 

According to some reports, according to the latest fee standard published by the World Intellectual Property Organization in November 2021, National Intellectual Property Administration issued the standard for collecting the fees of PCT application in the international phase. In light of the Agreement, every year, the World Intellectual Property Organization will publish the RMB standard of the fees of PCT application in the international phase for the next year. In principle, the standard will be effective for one year. If the standard needed to be adjusted due to excessive exchange rate fluctuation, it will be announced at another time.

 

It is learned that the international application fee of PCT submitted to the National Intellectual Property Administration and received after December 01, 2021 (included) and the handling fee for PCT international preliminary review requirements received after December 01, 2021 (included) shall be applicable to the RMB standard published in the notice. For the PCT application and the PCT international preliminary review requirements received before December 01, 2021, relevant fees shall be collected based on the Swiss Franc standard in the existing mode. In addition to the fees charged on behalf of the International Bureau, the standard for fees such as search fee collected by National Intellectual Property Administration will remain unchanged.
